CANADIAN CONTEST LAW PRECEDENTS

Our advertising and marketing clients often seek efficient and cost-effective ways to comply with Canadian contest/sweepstakes laws, while achieving their promotional contest marketing objectives (e.g., brand recognition and reinforcement, increased sales and building marketing/distribution lists).

As such, in addition to our legal services, we offer lawyer-prepared Canadian contest rules and forms precedent packages that can be purchased to run random draw and skill contests in Canada.

We also offer individual rules and forms precedents for Canadian contests/sweepstakes, including short or “mini-rules”, long rules, winner release forms and a Canadian contest law checklist.

Our downloadable Word format contest forms/precedents (PayPal checkout with credit card payment options) are an excellent way to efficiently run promotional contests/sweepstakes in Canada.

For more information and to order, see: Contest Forms and Contest Forms II.

CASL (CANADIAN ANTI-SPAM LAW) PRECEDENTS

Our clients often seek efficient and cost-effective ways to comply with Canadian federal anti-spam legislation (CASL), while achieving their electronic marketing objectives.

These commonly include documenting existing express consents, complying with CASL rules to send existing customers or others that inquire about a product/service e-mails, collecting e-mails online to comply with CASL and understanding the various B2B categories of implied consent and exemptions.

CASL related issues also commonly arise in connection with running contests in Canada (e.g., including CASL compliant consent requests, collecting consent for other or later marketing, etc.) – so it is important for contest sponsors to comply with CASL for electronic marketing in conjunction with Canadian contests. For more information, see: Canadian Contest Law & CASL.

As such, in addition to our legal services, we offer lawyer-prepared CASL precedents and checklists that identify key consent, disclosure and other requirements for electronic marketing to Canadians and provide checklists and templates to comply with the law.

Our compliance precedents and checklists are an excellent way to mitigate risk and avoid common CASL-related issues, including relating to express consent requests (including on behalf of third parties), sender identification information for CEMs, compliant unsubscribe mechanisms, business related exemptions and types of implied consent and documenting consent and scrubbing distribution lists. We also offer a CASL corporate compliance program that reflects the CRTC’s compliance program recommendations.

Each of our Canadian CASL precedents and checklists includes practical overviews of each of the relevant requirements, compliance checklists and guidance on how to use our precedents and templates for CASL compliance. Our precedents are Word version documents with PayPal checkout and credit card payment options.

For more information and to order see: Canadian CASL (Anti-Spam Law) Precedents and Checklists.
